1. Acceptance of Terms

By downloading, installing, or using the CLEVR application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

CLEVR is operated by CLEVR Social UG (haftungsbeschraenkt), registered in Germany.

2. Eligibility

  • You must be at least 16 years old to use CLEVR.
  • If you are between 16 and 18, you must have parental or guardian consent.
  • You must provide accurate, current information when creating an account.
  • You are responsible for maintaining the security of your account credentials.

3. What CLEVR Provides

CLEVR is an event planning and coordination platform. We provide tools for:

  • Creating and managing social events
  • Guest list management via party codes
  • Group messaging within events
  • Collaborative music playlists, food polls, task boards, and expense tracking
  • Interactive party games

CLEVR is a tool, not an event organizer. We do not host, sponsor, endorse, or take responsibility for any events created through the platform. Event hosts are solely responsible for their events and compliance with all applicable laws.

4. PROHIBITED CONTENT & ACTIVITIES

The following activities are strictly prohibited on CLEVR. Violation will result in immediate account termination, permanent ban, and forfeiture of any paid credits with no refund.

4.1 Illegal Activities

  • Drug-related events: Organizing, promoting, or discussing events where illegal drug use is intended, encouraged, or facilitated. This includes but is not limited to: drug parties, "sesh" gatherings, events where controlled substances are distributed or consumed.
  • Illegal raves & unlicensed events: Organizing events in unauthorized locations, trespassing on private or public property, or hosting events that violate local noise ordinances, zoning laws, or event permitting requirements.
  • Underage drinking events: Organizing events that specifically target or encourage alcohol consumption by minors (under 18 in EU, under 21 in US).
  • Weapons & violence: Organizing events involving illegal weapons, fighting, or any form of violence.
  • Fraud & scams: Using the platform to defraud guests, collect payments for fake events, or engage in any form of financial fraud.
  • Human trafficking & exploitation: Any event or activity that facilitates exploitation, trafficking, or abuse of any person.

4.2 Prohibited Chat Content

  • Discussion, solicitation, or promotion of illegal drug use or drug dealing
  • Sharing of explicit or pornographic content
  • Hate speech, racism, discrimination, or targeted harassment
  • Threats of violence or intimidation
  • Sharing of personal information of others without consent (doxxing)
  • Spam, phishing links, or malware distribution
  • Content that promotes self-harm or suicide
  • Any content that violates applicable local, national, or international law

4.3 Platform Abuse

  • Creating fake accounts or impersonating others
  • Attempting to access other users' data or accounts
  • Reverse engineering, decompiling, or attempting to extract source code
  • Using automated tools, bots, or scrapers to interact with the platform
  • Circumventing security measures, rate limits, or access controls
  • Using the platform for commercial advertising without authorization

5. REPORTING & ENFORCEMENT

5.1 Reporting Mechanism

Any user can report an event, message, or user for violating these Terms by:

  • Using the in-app "Flag" / "Report" feature on any event or chat message
  • Emailing support@clevr.social with details

5.2 Our Response

  • Automated detection: We employ keyword filtering and pattern detection in chat messages to identify potentially prohibited content. Flagged content may be reviewed by our safety team.
  • Community reporting: Events or messages that receive multiple reports will be automatically hidden pending review.
  • Review process: Reported content is reviewed within 24 hours. During review, the reported content or event may be temporarily suspended.

5.3 Consequences of Violations

  • First offense (minor): Warning + content removal
  • Second offense or serious violation: Account suspension (7-30 days)
  • Severe violation (illegal activity): Immediate permanent ban, all event data deleted, all paid credits forfeited with NO REFUND
  • Law enforcement: We will cooperate fully with law enforcement agencies and may proactively report illegal activities to relevant authorities

5.4 No Refund on Ban

Users who are banned for violating these Terms forfeit all remaining event credits, paid features, and are not entitled to any refund. This applies to both Party Pass and Party Pro purchases. By purchasing, you acknowledge and accept this policy.

6. Purchases & Payments

6.1 In-App Purchases

CLEVR offers one-time purchases (Party Pass, Party Pro) through Apple App Store and Google Play Store. All payments are processed by the respective store — CLEVR does not directly handle payment information.

6.2 Refund Policy

  • Refund requests for unused credits may be submitted within 14 days of purchase in accordance with EU consumer protection law (Widerrufsrecht)
  • Refunds are processed through Apple/Google, not directly by CLEVR
  • No refunds will be issued for accounts terminated due to Terms violations
  • Used event credits are non-refundable

6.3 Free Trial

The 7-day free trial for Party Pro allows full access to all features. If you do not cancel before the trial ends, you will be charged the one-time fee. No auto-renewal applies — Party Pro is a one-time purchase.

7. In-App Games Disclaimer

7.1 Nature of Games

CLEVR includes built-in party games designed for entertainment purposes only. The available games are:

  • Spin the Wheel — random dare/task selector
  • Who Am I — character guessing game
  • The Liar (Luegner) — word-based deception game
  • Music Battle — team-based song guessing
  • Digital Poker — virtual poker with play chips only

7.2 No Real Money Gambling

CLEVR games do NOT involve real money, real-money wagering, or gambling of any kind. All in-game currencies, chips, points, and scores are virtual, have no monetary value, and cannot be exchanged for real money, goods, or services. The Digital Poker game uses virtual play chips only — no real money is wagered, won, or lost.

7.3 No Simulated Gambling

Our games are not designed to simulate or replicate real-world casino or gambling experiences. They are casual social party games intended to be played in-person with friends at events. No game outcome provides any real-world reward or prize.

7.4 Age Appropriateness

All games are suitable for users aged 16 and above. Some games (like Spin the Wheel) may include party dares which are set to different spice levels by the event host. Hosts are responsible for ensuring dare content is appropriate for their event audience. CLEVR is not responsible for custom dare content created by hosts.

7.5 Prohibited Game Use

  • Using games as a mechanism for real-money gambling or betting
  • Organizing events where game outcomes determine real-money stakes
  • Creating dares/tasks in Spin the Wheel that involve illegal activity, drug use, or harm
  • Exploiting game mechanics through automated tools or cheating

Violation of game usage rules is subject to the same enforcement actions described in Section 5 (Reporting & Enforcement), including permanent ban and forfeiture of credits.

8. User Content & Intellectual Property

You retain ownership of content you create on CLEVR (event descriptions, messages, photos). By posting content, you grant CLEVR a non-exclusive, worldwide, royalty-free license to display, store, and transmit your content solely for the purpose of providing the service.

You may not upload content that infringes on third-party intellectual property rights (copyrighted music, trademarked names, etc.).

The CLEVR name, logo, and all platform features are the intellectual property of CLEVR Social UG and may not be used without written permission.

9. Limitation of Liability

CLEVR is provided "as is" without warranties of any kind. We are not liable for:

  • Events organized through the platform — hosts are solely responsible
  • Interactions between users at events
  • Loss of data due to technical failures (we make reasonable efforts to prevent this)
  • Temporary service interruptions
  • Actions of third parties (Spotify, payment providers, etc.)

Our total liability to you shall not exceed the amount you have paid to CLEVR in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold CLEVR harmless from any claims, damages, or expenses arising from:

  • Your use of the platform
  • Events you organize or attend through the platform
  • Your violation of these Terms
  • Your violation of any applicable law

11. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Germany. For EU consumers, mandatory consumer protection laws of your country of residence apply.

Any disputes shall first be attempted to be resolved amicably. If resolution cannot be reached, disputes shall be submitted to the courts of the registered office of CLEVR Social UG.

12. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

13. Termination

You may delete your account at any time through the app settings. We may terminate or suspend your account at any time for violations of these Terms.

Upon termination, your event data will be deleted within 30 days. Data required for legal compliance may be retained as required by law.
